This Privacy Policy describes how TapCap Inc., (the "TapCap", "we", "us", or "our") collects, uses, discloses, and otherwise processes personal information when you visit or use tapcaps.com (the “Site”) and any related websites, online store, products, promotions, giveaways, pop-up events, customer service channels, and other services that link to this Privacy Policy, or when you otherwise communicate with us (collectively, the “Services”).
For purposes of this Privacy Policy, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. “Personal information” does not include information that is excluded from the definition of personal information under applicable law, such as deidentified, aggregated, or publicly available information. For purposes of applicable privacy laws, TapCap is the controller or business responsible for the personal information described in this Privacy Policy, unless otherwise stated.

Information You Provide to Us

Marketing Communications
You may opt out of promotional emails by clicking the unsubscribe link in our emails or contacting us at support@tapcaps.com. You may opt out of promotional text messages by following the instructions in the message, such as replying “STOP.” Even if you opt out of promotional communications, we may still send transactional or administrative messages, such as order confirmations, shipping notices, account notices, or customer service communications.

Giveaways, Promotions, and Pop-Up Events
From time to time, we may offer or participate in giveaways, sweepstakes, contests, promotions, pop-up events, brand activations, or similar events, either directly or with partners, co-sponsors, venues, influencers, or vendors.
When you participate in a giveaway, promotion, or event, we may collect personal information such as your name, email address, phone number, mailing address, social media handle, age or eligibility confirmation, event registration information, photos or videos you choose to provide or permit us to capture, prize preferences, tax documentation where required, and other information needed to administer the promotion or event.
We may use this information to:
- administer the giveaway, sweepstakes, contest, promotion, or event;
- verify eligibility;
- communicate with participants;
- select and notify winners;
- fulfill prizes, discounts, samples, or promotional offers;

To the extent there is a conflict between this Privacy Policy and the official rules or terms for a specific promotion, the promotion-specific terms will control for that promotion.
If a promotion or pop-up event is conducted with a third-party partner, co-sponsor, venue, influencer, or vendor, we may disclose relevant personal information to that party as needed to administer the promotion or event, fulfill prizes, operate the event, or as otherwise disclosed at the time of collection. Those third parties may process your personal information under their own privacy policies where they independently determine how and why your personal information is used.
If we ask you to consent to receive marketing text messages or emails in connection with a giveaway, promotion, or event, your consent to marketing is not required as a condition of purchase unless expressly stated in promotion-specific terms and permitted by applicable law. You may opt out of promotional emails by using the unsubscribe link in the email and may opt out of promotional text messages by following the instructions provided in the message, such as replying “STOP.”
Cookies and Other Tracking Technologies
We and our service providers may use cookies, pixels, tags, web beacons, software development kits, local storage, and similar tracking technologies to operate the Services, remember your preferences, understand how users interact with the Services, measure the effectiveness of our marketing, prevent fraud, and personalize content and advertising.

Global Privacy Control. You can use the Global Privacy Control (“GPC”) through a supported browser to signal certain of your opt-out preferences. You may opt-out of the processing of your Personal Information for purposes of targeted advertising or certain sales of your personal information by broadcasting the Global Privacy Control Signal through a supported browser. If you use the GPC, we will process your request for your browser, but it will not apply outside of that browser to your device. You will need to use the GPC for each browser you use to access the website If you clear your cookies in your browser after using the GPC, you will need to use the GPC again for us to process your opt out for that browser.

User Generated Content
The Services may allow you to submit product reviews, photos, comments, feedback, testimonials, social media content, or other user-generated content. If you submit content to a public area of the Services, tag us on social media, or otherwise make content publicly available, that content may be visible to others.
We do not control who will have access to the information that you choose to make available to others and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties. We may use user-generated content you submit or make available to us for purposes such as operating the Services, responding to you, improving our products, marketing, and advertising, where permitted by law and subject to any consent requirements or promotion-specific terms that apply.

Our Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Children's Privacy
The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe that a child under 13 has provided personal information to us, please contact us using the information below, and we will take appropriate steps to delete the information.
We do not knowingly sell or share personal information of individuals under 18 years of age.
If TapCap offers promotions, giveaways, or pop-up events that are limited to individuals of a certain age, we may request information reasonably necessary to confirm eligibility.
Security and Retention
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Sale/Sharing for targeted advertising: TapCap does not sell personal information. TapCap does not share personal information for cross-context behavioral advertising (also called targeted advertising) as those terms may be defined under certain U.S. state privacy laws.
Sensitive personal information: TapCap uses sensitive personal information only for purposes such as providing services, credentialing, security, fraud prevention, and compliance with law, as described above, and not to infer characteristics about you for targeted advertising.
Non-discrimination: TapCap will not discriminate against you for exercising your privacy rights.

We may need to verify your identity before processing certain requests. We will respond within the time required by applicable law.
Authorized agents (where applicable): In some U.S. states, you may designate an authorized agent to submit a request on your behalf. If you use an authorized agent, we may ask for proof that the agent is authorized, and we may also require you to verify your identity directly with us.
Appeals (where applicable): If we deny your request, you may have the right to appeal our decision. We will review and respond within the time required by applicable law.
